Amazon Partner Privacy Policy

This Amazon partner privacy policy (the “Amazon Partner Privacy Policy”) applies to Amazon Customer Information (hereinafter defined) collected by us through our use of and fulfillment through Amazon. If you are a customer of an Aterian Group product through your use of Amazon, then except as expressly set forth below, this Amazon Partner Privacy Policy, in addition to the Aterian Group Privacy Policy, applies to your use of such Website(s) or Service(s) (as defined below).

If you are a visitor to or user of an Amazon webpage utilized by Aterian Group to further our business operations (“Amazon”), then any Amazon Customer Information you submit to or through Amazon (including via the Aterian Group Website), in addition to the collection by Aterian Group, is collected under the privacy policy of Amazon, and you should contact Amazon with any related requests or inquiries you may have. If you have any inquiries specifically directed towards Aterian Group, please email us at privacy-policy@aterian.io. 

At Aterian Group, we respect the privacy rights of our users and recognize the importance of protecting the Amazon Customer Information we may collect about you. Our Privacy Policy and Amazon Partner Privacy Policy is designed to help you understand what information we collect and how we use and share that information. This Amazon Partner Privacy Policy applies to our use of Amazon’s website and services. 

As used in this Amazon Partner Privacy Policy, “Aterian Group,” “us” and “we” refers to Aterian, Inc. and its affiliates, employees, agents, parent company, subsidiaries or other individuals that have a need to know Amazon Customer Information. The “Website(s)” means the Amazon webpages through which Aterian Group advertises and places for sale its products and by which you purchase such products. The “Service(s)” means Aterian Group’s Brands’ Stores on Amazon, including without limitation those products for sale under the names hOmeLabs, Vremi, Xtava, RIF6, Aussie Health Co., Holonix, Truweo, Mueller, Pohl and Schmitt, Pursteam, Spiralizer, Healing Solutions, LLC, Squatty Potty, and Photo Paper Direct. The Website(s) and Service(s) are collectively referred to herein as the “Offerings.” Your “Amazon Customer Information” means information that you provide to us that is capable of personally identifying an individual.

Section 1 – Information We Collect

Amazon Customer Information Collected in General. We collect Amazon Customer Information about you in order to fulfill orders made by consumers or merchants through our Offerings. In particular, we collect Amazon Customer Information:

  1. When we fetch orders fulfilled by merchant (the “FBM Orders”);
  2. When we fetch orders fulfilled by Amazon (the “FBA Orders”);
  3. When you make a customer support inquiry directly to us that requires the shipment of a replacement product to you;
  4. When fulfilling an order requires manual intervention by us due to incorrect shipping information.

Amazon Customer Information Collected by Us. The Amazon Customer Information collected from the Order Fulfillment Process, FBM Orders and received by customer support may include your name, email address, phone number, and shipping address, which includes your street address, district and postal code. The Amazon Customer Information collected from FBA orders may include up to a 9-digit postal code. 

Section 2 – How We Store and Use the Amazon Customer Information We Collect

General Use and Collection. We collect and use your Amazon Customer Information only for the purpose of, and for so long as is necessary to fulfill orders made by consumers or merchants through our Offerings.

The Amazon Customer Information we collect is encrypted both in-flight and at rest. Access to the database is network restricted and it is only accessible to a limited number of individuals on a need-to-know basis. In general, no manual access to the Amazon Customer Information we collect is required for a successful fulfillment process, such that no employee is exposed to the collected information.

Section 3 – How We Process the Amazon Customer Information We Collect

Amazon Customer Information Processed by FBM Orders. The Amazon Customer Information we may collect when processing an FBM Order may be stored in our database when we fulfill an order through our Offerings. During the fulfillment process, we may share only that Amazon Customer Information with third-parties necessary in order to process and complete fulfilment.

Amazon Customer Information Processed by FBA Orders. We may have contact with your Amazon Customer Information when we fetch FBA Orders. In this instance, the only Amazon Customer Information we may be exposed to is your 9-digit postal code, which is sanitized to a 5-digit postal code before the order associated with that postal code is stored in our database (in accordance with Section 2).

Section 4 – Sharing Your Amazon Customer Information with Third Parties

Third Party Sharing for Fulfillment Purposes. We may share your Amazon Customer Information to third parties to the extent it is required to fulfill and deliver the order to the customer or merchant.

Other Third-Party Sharing. Except to the extent otherwise described herein, we do not use, sell, trade, share or transfer your Amazon Customer Information to third parties unless we have a good faith belief that access, use, preservation or disclosure of such Amazon Customer Information is reasonably necessary to satisfy any applicable law, regulation, legal process or enforceable governmental request, or protect against imminent harm to our rights, property or safety, or that of our users or the public as required or permitted by law.

Section 5 – Disposal of Your Amazon Customer Information

Removal of Your Amazon Customer Information. The removal of your Amazon Customer Information is part of both our fulfillment and cancellation process.

Disposal of Amazon Customer Information in the Fulfillment Process. Once the fulfillment process is complete, the Amazon Customer Information that is collected in accordance with this Amazon Partner Privacy Policy is disposed of promptly, but in no event later than thirty (30) days after the Amazon Customer Information is initially collected. Upon successful fulfillment of the shipment, the collected Amazon Customer Information is immediately removed from our database. In the event an error occurs during the fulfillment process, such Amazon Customer Information is held for only so long as it is required in order to successfully complete the fulfillment process, but in no event later than thirty (30) days.

Disposal of Amazon Customer Information Upon Cancellation. If an Amazon shipment is properly cancelled by a consumer or merchant before the fulfillment process by us is complete, any collected Amazon Customer Information is immediately removed from our database. 

Details of Removal of Amazon Customer Information. Once your Amazon Customer Information is removed, your name, email address, phone number, shipping address, and district, as applicable, will be overridden with empty characters and will no longer be identifiable or available in our database. In the event you provided a postal code to us, that 9-digit postal code will be reduced to a 5-digit postal code.

Section 6 – California Privacy Rights

California residents have the right to ask us one time each year if we have shared their personal information with third parties for direct marketing purposes. To make a request, please email us at privacy-policy@aterian.io, and indicate “California Shine the Light Inquiry” in the subject line.

Section 7 – Security Measures

We are committed to taking reasonable efforts to secure the Amazon Customer Information that is provided to us, and we use a variety of security technologies and procedures to help protect against unauthorized access to or alteration, disclosure, or destruction of data. Even though we take reasonable steps to secure your information, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot fully guarantee the security of the Amazon Customer Information that is provided to us. Questions about the security of Amazon Customer Information provided to us or this Amazon Partner Privacy Policy, should be directed to us by sending us an email at privacy-policy@aterian.io, indicating “Security Inquiry” in the subject line.

Section 8 – Children

Our services are not intended for us by or targeted at children under 13, and we do not knowingly or intentionally collect information about children under 13. We may provide links to third-party websites that allow children under the age of 13 to register for use of the website, or are targeted at children under 13. In such instances, the third-parties are responsible for ensuring that their websites comply with applicable laws, regulations, and rules.

Section 9 – Using Our Offerings from Outside the United States

If you use our Offerings outside of the United States, please be aware that Amazon Customer Information about such use may be transferred to, stored, and processed in the United States, where our servers are located and our central database is operated. Please be aware that the data protection and other laws of the United States might not be as comprehensive as those in your country. By using our Offerings, you agree that your Amazon Customer Information may be transferred to our facilities and those third parties with whom we share it in accordance with this Amazon Partner Privacy Policy.

Section 10 – Inapplicability of Privacy Policies of Any Third Parties

This Amazon Partner Privacy Policy only addresses our use and disclosure of your Amazon Customer Information. It does not address, and we are not responsible for, the privacy or securities practices of any third parties, including Amazon and any other third party operating any software application or website to which we may contain a link. The inclusion of a link through our Offerings does not imply endorsement of the linked software application or website by us. We encourage visitors to carefully read the privacy policies of other websites you visit.

Section 11 – Data Retention

Unless earlier removed in accordance with this Amazon Partner Privacy Policy, we retain Amazon Customer Information only for so long as it is required to fulfill orders made by consumers or merchants through our Offerings, but in no event longer than thirty (30) days. We also keep information as otherwise required by law.

Section 12 – How You Can Access and Change Your Amazon Customer Information

You can update or correct the Amazon Customer Information provided to us in accordance with this Amazon Partner Privacy Policy, or, remove it from our system (prior to removal by us in accordance with Section 5) by making a request to us at privacy-policy@aterian.io. If for some reason access is denied, we will provide an explanation of why access has been denied.

Section 13 – Conditions of Use of Our Offerings

By using our Offerings, you agree to the terms and conditions contained in this Amazon Partner Privacy Policy and any other agreement we might have with you. If you do not agree to any of these terms and conditions, you should not use our Offerings.

Section 14 – Changes to the Amazon Partner Privacy Policy

As Aterian Group, its products, and its services change from time to time, this Amazon Partner Privacy Policy is expected to change as well. We reserve the right to amend the Amazon Partner Privacy Policy at any time, for any reason, and may do so by posting a new version online.
